Terms of Service

Welcome to Spot MK. These Terms of Service ("Terms") govern your use of the Spot MK mobile application ("the App"), operated by Edvin Hajrulovski. By creating an account or using the App, you agree to these Terms.

1. About the App

Spot MK is a reservation platform that connects customers with local businesses. Customers can browse businesses, view availability, and make reservations. Business owners can create listings, manage their team, and handle incoming reservation requests.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Accounts

• You are responsible for keeping your login credentials secure.
• You must provide accurate information when creating an account.
• You may not create accounts for someone else without their consent.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Customer Use

• Reservations made through the App are requests to the business. A confirmed reservation represents an agreement between you and the business, not with Spot MK.
• Please arrive on time or cancel your reservation in advance. Repeated no-shows may result in account restrictions.
• Reviews must be honest and based on genuine experiences. We may remove reviews that contain offensive content, spam, or false information.

5. Business Owner Use

• Business owners are responsible for the accuracy of their listing information (name, address, hours, services, photos).
• Business owners must honor confirmed reservations or communicate cancellations to customers promptly.
• You must have the right to represent the business you register.
• Listings that are fraudulent, misleading, or that promote illegal activities will be removed.

6. Worker Accounts

Business owners can invite team members (workers) by email. Workers receive an invitation link to set their password and activate their account. Worker accounts are associated with the inviting business.

7. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose.
• Impersonate another person or business.
• Submit false reservations or spam businesses with fake requests.
• Attempt to access other users' accounts or data.
• Interfere with or disrupt the App's infrastructure.
• Scrape, crawl, or automated-access the App without permission.

8. Intellectual Property

The App, its design, code, and branding are the property of Edvin Hajrulovski. You may not copy, modify, or distribute any part of the App without written permission. Content you submit (reviews, business photos) remains yours, but you grant us a license to display it within the App.

9. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be available at all times or free of errors. We are not responsible for the quality, safety, or legality of any business listed on the platform, nor for the conduct of any user.

10. Limitation of Liability

To the maximum extent permitted by law, Spot MK and its operator shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability for any claim shall not exceed the amount you have paid us (if any) in the 12 months preceding the claim.

11. Disputes Between Users

Spot MK is a platform that facilitates connections between customers and businesses. Any disputes regarding reservations, services, or payments are between the customer and the business. We are not a party to those transactions and are not responsible for resolving such disputes.

12. Account Deletion

You may delete your account at any time from the Profile screen in the App. Deleting your account permanently removes your personal data. Business listings associated with a deleted owner account may also be removed.

13. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes through the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of North Macedonia. Any disputes shall be resolved by the competent courts in Skopje, North Macedonia.
